Nationwide Use of Remote Online Notarization (RON)

As Congress looks to provide solutions amidst the evolving economic challenges faced by consumers and businesses, Senators Kevin Cramer (R-ND) and Mark Warner (D-VA) have introduced S. 3533 and Representatives Madeleine Dean (D-PA) and Guy Reschenthaler (R-PA) have introduced H.R. 6364.

These bipartisan bills would allow notaries in states without enacted remote online notarization (RON) laws to perform RON transactions. States with an enacted RON law that meets minimum standards defined in the federal bills would not be preempted, and any RON law passed by a state in the future would govern RON transactions there, provided they meet these minimum standards. The bills’ minimum standards for RON are consistent with those provided in the MBA-ALTA model state RON bill and the Mortgage Industry Maintenance Standards Organization (MISMO) RON Standards. 

In addition to providing a valuable tool to continue operations during this period of national crisis, these bills are a powerful tool to motivate state legislatures to enact their own RON laws. MBA and industry partners are advocating for the inclusion of these bills in an emergency package to provide economic relief during these difficult times.
